Category 1. 23.2.1 Liquidated damages up to $100,000 per violation may be imposed for Category 1 events. For Category 1 events, the Contractor shall submit a written CAPA/PC to DCH for review and approval prior to implementing the corrective action. Category 1 events are monitored by DCH to determine compliance and shall include and constitute the following: · Acts that discriminate among Members on the basis of their health status or need for health care services; and · Misrepresentation of actions or falsification of information furnished to CMS or the State. · Failure to implement requirements stated in the Contractor’s proposal, the RFP, this Contract, or other material failures in the Contractor’s duties. · Failure to participate in a readiness and/or annual review. · Failure to provide an adequate provider network of physicians, pharmacies, hospitals, and other specified health care Providers in order to assure member access to all Covered Services.
Category 1 a. School year employees – 189 workdays including paid holidays.
b. Classroom Assistants/HQ Classroom Assistants, Office Aides, HQ CARES Classroom Assistants, Health Technicians, and Nutrition Services Employees, excluding Nutrition Services Managers may be employed to work 177 through 180 days, depending on the number of non-serving days during parent-teacher conference days. Nutrition Services Managers may be employed to work 181 through 185 days, depending on the number of non-serving days they are needed to work as determined by administration. Paid holidays shall be in addition to the above. Members of the bargaining unit may be requested to provide service beyond their contractual agreement. Such service shall be voluntary and paid at the employee's regular hourly rate. If an employee is eligible for overtime, it shall be in accordance with the overtime provisions of this article.
c. There shall be one eight (8) month Groundskeeper in addition to the Groundskeepers that are employed as twelve (12) month employees. The eight

These speakers/trainers may present the MPCP segment at an UnFranchise Business Presentation (“UBP”), conduct New UnFranchise Owner Trainings (“NUOT”), and conduct Basic Five (“B5”) Trainings at an approved publicly scheduled GMTSS meeting/training where attendees are charged an admission fee. Category 1 Speakers must:
(a) earn a minimum of AUD$1,500 in commissions each calendar quarter one (1) or more BDCs;
(b) personally sponsor two (2) UnFranchise Owners during the previous calendar year;
(c) purchase five (5) tickets from Market America for the Leadership School and submit the ticket numbers to the GMTSS Department within sixty (60) days following each Annual Convention, and five (5) tickets from the Company for the Annual Convention and submit the ticket numbers to the GMTSS Department within sixty (60) days following each Leadership School; and
(d) qualify as a Shopping Annuity Master Member at least one (1) quarter per year.
Category 1. Full-time personnel working minimum of eight hours per day (40 hours a week) for 52 weeks.

(c) purchase five (5) tickets from Market Hong Kong for the Annual Convention and submit the ticket numbers to the GMTSS Department within sixty (60) days following each Leadership School, and five (5) tickets from the Company for the Leadership School and submit the ticket numbers to the GMTSS Department within sixty (60) days following each Annual Convention; and
(d) qualify as a Shopping Annuity Master Member at least one (1) quarter per year. *Speaker may conduct NUOTs for educational purposes only. Any NUOT conducted by Speaker will not satisfy new UnFranchise Owners’ 28 day requirement. This requirement can only be met by attending a NUOT conducted by Market Hong Kong at the local corporate office.
Category 1. Members of the unit shall not be required to secure advance permission for Personal Necessity Leave taken for any of the following reasons:
10.3.1 Death or serious illness of a member of his/her immediate family. Serious illness is defined as an illness where death is imminent, may result in permanent disability or requires hospitalization. The members of the immediate family are those persons identified in the rules governing Bereavement Leave.

Category 1. Literally Homeless: Individual who lacks a fixed, regular, and adequate nighttime residence,
(1) Has a primary nighttime residence that is a public or private place not meant for human habitation;
(2) Is living in a publicly or privately operated shelter designated to provide temporary living arrangements (including congregate shelters, transitional housing, and hotels and motels paid for by charitable organizations or by federal, state and local government programs); or
(3) Is exiting an institution where (s)he has resided for 90 days or less and who resided in an emergency shelter or place not meant for human habitation immediately before entering that institution.
