CHWM Contract definition

CHWM Contract. (08/15/08 Version) means the power sales contract between a customer and BPA that contains a Contract High Water Mark (CHWM), and under which the customer purchases power from BPA at rates established by BPA in accordance with the TRM.

  • Each COU Party hereby agrees that Exhibit H of its CHWM Contract is, as of the Effective Date, replaced in its entirety consistent with the template form of Exhibit H set forth as Exhibit H to this Settlement Agreement.

  • BPA will, within 60 days of the Effective Date, deliver to each COU Party a replacement Exhibit H to its CHWM Contract identical in form to the Exhibit H attached to this Settlement Agreement except for the insertion of the appropriate contract number and customer name, which will be effective from the Effective Date without further action or signature by BPA or the COU Party.

  • Termination of Jefferson’s CHWM Contract shall be effective at commencement of service under the alternative power sales contract.

  • Jefferson acknowledges that the terms and conditions of such alternative power sales contract may vary from those contained in the CHWM Contract.

  • If Jefferson fails to notify BPA within the 60-day period of its decision regarding its CHWM Contract, BPA’s offer of the alternative power sales contract without a CHWM shall be withdrawn as of the 61st day and Jefferson will be conclusively presumed to have elected to retain its CHWM Contract.
