O&M Contract definition

O&M Contract means the operation and maintenance contract that may be entered into between the Concessionaire and the O&M Contractor for performance of all or any of the O&M obligations;
O&M Contract means the operation and maintenance contract that may be entered into between the Developer and the O&M Contractor for performance of all or any of the O&M obligations;

  • If Developer elects not to self-perform any aspect of the operations and maintenance of the Project, including toll operations, it shall enter into an O&M Contract for such O&M Work.

More Definitions of O&M Contract

O&M Contract means the Operation and Maintenance Contract that may be entered into between the Concessionaire and the O&M Contractor for O&M of the Project/Project Facility.
O&M Contract means any direct Contract between Developer or an Affiliate and a third party (i.e. a Person other than TxDOT) for management, direction, supervision or performance of the O&M Work or any significant portion thereof. O&M Contract includes any direct Contract between Developer or an Affiliate and a third party for operation or maintenance of all or any part of the tolling system for the Project. There may be more than one O&M Contract concurrently in effect. For the purpose hereof, “significant portion” means that the third party’s annual contract price equals or is reasonably expected to equal at least 15% of Developer’s annual budget for O&M Work (excluding budgeted costs for Renewal Work).
O&M Contract means the Operations and Maintenance Contract effective July 29, 1993 between Iridium and Motorola, as amended from time to time.
