The Citizen of the European Union Act provides for the legal bases of the temporary stay and residence in Estonia of citizens of the member states of the European Union, citizens of the member states of the European Economic Area or citizens of the Swiss Confederation and their family members.
Aliens are prohibited to stay in Estonia without a legal basis.(2) The legal bases for an alien to stay in Estonia (hereinafter bases for stay) are provided for in the Aliens Act.(3) The legal bases for the citizens of the Member States of the European Union, citizens of the member states of the European Economic Area or the Swiss Confederation and their family members of their stay and residence in Estonia (hereinafter bases for stay) are provided for in the Citizen of the European Union Act.
The reasons for immigration vary and include all the bases for granting a residence permit under the Estonian Aliens Act, the bases for staying in the country under the Citizen of the European Union Act and the bases for granting a residence permit under the Act on Granting International Protection to Aliens.
The Citizen of the European Union Act also lists sham marriage among the reasons for refusal to grant a temporary right of residence (ELKS, (RT I, 23.03.2015, 13) § 26).
In this case, spouses of EU citizens would apply for family reunification under the Citizen of the European Union Act and not under the Aliens Act.
Public sanitary sewer means a sewer in which all owners of abutting properties have equal rights, which is placed in a public right-of-way or dedicated easement, which was constructed according to city specifications for public sanitary sewers applicable at the time of its installation or accepted as substantially equivalent in writing by the city.
Subsection 22 (2) of the Population Register Act is amended by adding clause 151) worded as follows: «151) a residence permit issued pursuant to the Citizen of the European Union Act;”.
In 2002 the Aliens act was harmonized with two resolutions of the Council of the European Union on family reunification24 and fictive marriages25 and the Citizen of the European Union Act was adopted which regulates the residence of EU citizens and their family members in Estonia.

A resident of Estonia who has residence in several states has the right to receive the benefit if he or she is a resident within the meaning of subsection 6 (1) of the Income Tax Act or if he or she resides permanently in Estonia within the meaning of the Aliens Act or the Citizen of the European Union Act.
