The Santa Fe Homes Program (“SFHP” or the “Program”) was established by the City Council of Santa Fe by Ordinance No. 2005-30 and is codified in Chapter 26 of the Santa Fe City Code 1987 (the “Ordinance”).
Recipient represents and warrants that the information contained in the grant application is true, correct, and complete in all material respects as of the date of this Agreement and that the Project will, at all times, satisfy the definition of qualified affordable housing in section 16.3.020 of the Yachats City Code.
The terms, conditions, wages, and all provisions of this MOU shall continue in effect until a new MOU is negotiated and subsequently ratified by the Association and the City Council, or until this MOU is superseded in accordance with City Code Section 25-16.12(e) (Impasse Procedure) as may be amended, or until the Association dissolves pursuant to City Code Section 15- 16.10 (Decertification of Recognized Employee Organizations), as may be amended.
Monterey City Code Section 25-5.12 Special Assignment Pay, authorizes the City Manager or designee to give not less than two percent (2.0%) and not more than five percent (5.0%) in a temporary pay adjustment.
Recipient covenants and agrees that: (a) all funds received from the Affordable Housing Fund will be used for the purposes specified in the grant application and in this Agreement; (b) if the Project ceases to be qualified affordable housing as defined in section 3.16.020 of the Yachats City Code before the income restriction period ends, Recipient shall promptly repay to the City all amounts previously paid by the City hereunder.
