In addition to the General Requirements set forth in Section 2 hereof, each Aircraft Rental/Flying Club Operator at the Airport shall comply with the following Minimum Standards.
Club Operator hereby grants to Member a Membership, constituting a license to use all or a portion of the Club Facilities in accordance with the privileges of such class of membership as set forth in the Membership Policies.
A Flying Club Operator is an Entity comprised of an association or group of more than three (3)individuals jointly owning or leasing an Aircraft to its members (where payment is made to the club for the operating time of the Aircraft), but which does not meet the requirements established for exempt Flying Clubs.
All such Club Charges, together with any late fees, interest (computed from its due date at a maximum rate of 18% per annum or such other rate as Club Operator may establish in the Membership Documents, subject to the limitations of Virginia law), costs of collection, and reasonable attorneys' fees whether or not suit is brought, shall be the personal obligation of person or entity who was the Unit Owner at the time the Club Charges were levied.
Any temporary suspension of membership privileges shall be for such period as Club Operator deems appropriate.
Club Charges shall be determined by the Club Operator from time to time, and are subject to change as contemplated by the Membership Documents.
Additionally, in the event that the Club Operator or Club Owner brings an action against Unit Owner for enforcement of any such violations, whether to enjoin or restrain such violation or attempted violation or for specific performance or to recover damages, or both, then the Club Operator or Club Owner, if the prevailing party, shall be entitled to recover its costs and reasonable attorney fees pursuant thereto.
All costs of enforcement and/or cure incurred by the Club Operator or Club Owner shall be treated as additional Club Charges owed by the applicable Unit Owner.
Nothing herein shall obligate Club Operator or the Club Owner to offer or maintain food and beverage service nor shall anything herein dictate the level of service or hours of operation of any food and beverage service provided.
The Club Property is privately owned or leased by Club Owner and operated by the Club Owner, its successors or assigns, or such other person as the Club Owner or then owner of the Club Property may designate (the "Club Operator") and is not a part of the property and facilities held by the Association, including property owned by the Association for the common use or benefit of more than one Unit (the "Common Areas"), under the terms of the Declaration.
