In case of ITT deliveries the Delivery Date shall mean the date of Goods transfer from Seller’s tank into Buyer’s tank at the Terminal as specified in the Certificate of ITT issued and duly signed by the appropriate Terminal operator and the Inspector.
Terminal operator" means any person that owns, operates, or otherwise controls a terminal, and does not use a substantial portion of the motor fuel that is transferred through or stored in the terminal for its own use or consumption or in the manufacture of products other than motor fuel.
