Common Security Holder definition

Common Security Holder means the Parent, as the owner of the Common Securities.
Common Security Holder means the holder of the Common Securities of the Trust.
Common Security Holder means the Person (or Persons, as the case may be) in whose name Common Securities are registered, such Person or Persons being a beneficial owner (or beneficial owners, as the case may be) within the meaning of the Business Trust Act.

  • Such determination shall be made (i) by the Administrators by a majority vote of a Quorum consisting of such Administrators who were not parties to such action, suit or proceeding, (ii) if such a Quorum is not obtainable, or, even if obtainable, if a Quorum of disinterested Administrators so directs, by independent legal counsel in a written opinion, or (iii) by the Common Security Holder of the Trust.

  • In no event shall any advance be made in instances where the Administrators, independent legal counsel or the Common Security Holder reasonably determine that such Indemnified Person deliberately breached his duty to the Trust or its Common or Capital Security Holders.
