In addition to any other remedies Hero Power may have, this Agreement may be terminated by Hero Power upon a 30 day notice to you if you move, you cease to be a ComEd customer, you become ineligible for ComEd Consolidated Billing, or there is a material adverse change that prevents Hero Power from performance.
Your payment will be due to the LDU for Consolidated Billing, or to Oasis Energy for Supplier Billing, by the date specified on the invoice.
If Supplier provides Consolidated Billing service, Supplier will be responsible for fulfilling all applicable New Jersey Administrative Code (“NJAC”) and Board-mandated notices and directives concerning utility customer ▇▇▇▇ information and format, and other regulatorily- mandated notices and information relating to Company’s tariffed delivery services.
If Consolidated Billing is provided, the Billing Party, whether it is the Company or Supplier, shall assume the Non-Billing Party’s undisputed charges as receivables.
In addition to the creditworthiness requirements specified in the Third Party Supplier Agreement, if and only if Supplier is performing Consolidated Billing under this Agreement, the Company will determine whether Supplier is creditworthy.
