Upon execution of this Agreement, this Agreement shall replace the County PILOT Agreement for the Properties defined herein, as well as replace any other prior agreements among the parties regarding any PILOT payments not heretofore mentioned.
It is understood that no portion of any County PILOT payment will be redirected to the Fund.
Notwithstanding anything to the contrary contained herein and irrespective of any lesser assessed value established by the PVA in any calendar year prior to the Constructed Assessment Date (defined in Section 2(b) below), for purposes of calculating the City PILOT Payment and the County PILOT Payment amounts, the assessed valuation of the Property and the Project shall not be less than $806,000 (the “Base Line Value”).
