Daily Fees definition

Daily Fees means, as of any date of determination, for any Loan, a per diem fee equal to the product of (a) the sum of (i) the greater of 1 Month SOFR on the Rate Transition Date (expressed as basis points per diem) and the Minimum SOFR Rate (expressed as basis points per diem) plus (ii) the applicable Tier Charge (expressed as basis points), multiplied by (b) the Cost Basis for such Loan.

Daily Fees shall be limited to the fees charged by Licensee to the Tribal Casinos for the Bally Games under its software agreements within the Territory, and shall not include any rents, hardware maintenance fees or other payments charged by Licensee under its equipment agreements, hardware maintenance agreements or other agreements within the Territory.   • Monthly Fees means, collectively, [INSERT FOR HFS: the Monthly Food and Beverage Fee,] the Monthly Program Fee and the Monthly Royalty Fee, each of which is set forth in the Addendum.
