DAMAGED PRODUCT definition

DAMAGED PRODUCT means any Product which has been damaged or is otherwise unfit for distribution to the Company System.
DAMAGED PRODUCT. Any product "disassembled" by the customer will VOID all warranties. This will assist us in making a correct determination as to problem resolution. Pack Returns Carefully: Customers must pack defective items being returned as if they were new and working. Failure to do so may invalidate both the RMA and the warranty. MCA Communications is not responsible for goods that are damaged during shipment or misused/abused by the customer/carrier.   • In the “WHAT IS NOT COVERED” section of this Service Contract, exclusion (A) is removed and replaced with: ANY AND ALL PRE-EXISTING CONDITIONS KNOWN BY YOU THAT OCCUR PRIOR TO THE EFFECTIVE DATE OF THIS SERVICE CONTRACT AND/OR ANY PREVIOUSLY DAMAGED PRODUCT.

  • IN NO EVENT, SHALL UT BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE LESSER OF THE COST OF REPLACEMENT OR REFUND OF THE NET PURCHASE PRICE PAID BY DISTRIBUTOR FOR ANY DEFECTIVE OR DAMAGED PRODUCT.
