Deemed Compliance with Proposition 65. The Parties agree that compliance by Xxxxxxxx with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to DEHP from use of the Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Ultratech with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to DINP from use of the Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Third Party with this Agreement constitutes compliance with Proposition 65 with respect to exposure to styrene from use of the Covered Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by the Settling Entity with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to lead from use of the Product.
Deemed Compliance with Proposition 65. Compliance by Enchante with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposures to DEHP in the Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Mous with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to BPA from use of the Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Gourmet Home with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to DEHP from use of the Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Telecom with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to BPA from use of the Products.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Metolius with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to CrVI from use of the Products. The Parties agree that after the Effective Date, should complaince with Proposition 65 with respect to CrVI from use of the Products be governed by operation of law (i.e., Court Order regarding CrVI in leather products, or other regulatory exemption) Metolius may choose to comply with such operation of law and such action would not be a breach or violation of this Settlement Agreement.
Deemed Compliance with Proposition 65. The Parties agree that compliance by Yogi with this Settlement Agreement constitutes compliance with Proposition 65 with respect to exposure to DEHP from use of the Products.
