Use of the Products. 2.1 Ovid hereby grants to Subscriber the non-transferable, nonexclusive limited right to gain computerized access using the Software to the Product(s), subject to the terms and conditions of this Agreement. Authorized Users will use the Product(s) only in accordance with the Permitted Use.

Use of the Products. 1. The Client will always use the Products to the exclusion of third parties in accordance with the intended purpose under the hire agreement. The Client shall use the Products exclusively in and on behalf of their own organisation or company. The Client is only permitted to sublet the Products to any third party or to allow any third party to use or co-use them in any other form after written permission from AnyWare. 2. The Client is not permitted to use the Products or any part thereof as collateral or security object, in any way whatsoever, against any third party or to dispose of them in any other way. 3. The Client shall use and retain the Products and Services with due care. When using the Products and Services, the Client shall observe all applicable regulations, including the manual, any safety regulations and these terms and conditions. 4. The Client shall take timely and effective measures to prevent damage to the Products. In the event of damage to the Products, the Client will immediately notify AnyWare thereof in writing. The Client is fully liable for damage and defects to the Products towards AnyWare and the third parties affected by the damage.
Use of the Products. 2.1 Subject to the timely payment by the Customer of the Subscription Fees and solely during the Subscription Term, Qubit grants to the Customer a non-exclusive, non-transferable right to: (a) permit the Authorised Users to use the Products; and (b) permit Third Party Users to use the Products; and (c) permit a Customer Affiliate or Affiliates listed in the Sales Order Form and its employees and workers to use the Products in each case solely for the Customer's internal business operations (and if applicable the business purposes of a relevant Customer Affiliate); Nothing in this Agreement limits Customer’s liability for a breach of this clause 2.1 by the Customer. 2.2 Qubit permits the Customer (or if applicable the Customer Affiliate) to download the Script (including any updates to the Script that Qubit may make available from time to time) for the sole purpose of permitting the Customer (or if applicable the Customer Affiliate) to integrate the Customer Site with the Product. 2.3 The Customer shall be solely responsible for any failure of a Customer Affiliate, an Authorised User or Third Party User to comply with the terms of the Agreement and shall ensure that, Customer Affiliates, Authorised Users and Third Party Users discontinue use upon termination of the Agreement. 2.4 The Customer shall: (i) use all reasonable endeavours to not (and shall procure that Authorised Users, Third Party Users and Customer Affiliates shall use all reasonable endeavours to not) access, store, distribute or transmit any Viruses when accessing and using the Products; (ii) not use the Products in a manner that is illegal or causes damage or injury to any person or property; (iii) not use any automated system, including "robots," "spiders," "offline readers," to access the Product in a manner that sends more request messages to the Product than a human can reasonably produce in the same period of time by using a conventional online web browser; or (iv) not attempt to interfere with or compromise the Product integrity or security. Qubit may, without liability or prejudice to its other rights under the Agreement, disable the Customer’s, the Authorised Users’, the Third Party Users’ or the Customer’s Affiliate(s) access to the Product for breaches of the provisions of this clause 2.4 if the breach may have an adverse impact. 2.5 The Customer shall not: (a) except as may be allowed by any applicable law which is incapable of exclusion by agreement between the parties: (i) and e...

If Customer purchases a subscription for Snow Cloud Cost, any Anadot product or service purchased through Snow, or any other Snow software which incorporates Anodot Cost or other Anodot software, all such use shall be governed by xxxxx://xxx.xxxxxxxxxxxx.xxx/anodot-xxxx (“Anodot XXXX”). Snow may update the Anodot XXXX at any time, but in no event will Snow materially degrade the Anodot XXXX during the Product Term.
Use of the Products. The use of an Access Number with 5 dialling numbers is solely attached to the Bulk Messaging Product for the delivery of messages to End Users in Telia’s communication network, where an Access Number of 5 dialling numbers is the sender or is set as a sender. An exception is made when messages are sent from other Norwegian mobile operators. The Customer is not allowed to use other Products but Telia CPA Bulk Messaging for the delivery of messages to End Users in Telia’s communication network with an alphanumeric sender. An exception is made when messages are sent from other Norwegian mobile operators. The Customer shall save logs over all sent SMS or MMS messages for at least three months. The authorities may restrict the storage of the content of messages. Where such restrictions conflict with the first sentence of this Section, these restrictions have the first priority. The Customer shall secure that he has agreement with Telia about– or written agreement of operations for – Access Numbers that is defined as originating address of mobile terminated SMS or MMS messages sent by the Customer. Alphanumeric originating address of SMS or MMS messages shall be a company registered in the Register of Business Enterprises (Foretaksregisteret i Brønnøysund) or a registered trade mark owned by this company, and the Customer shall have an agreement with this company to use the company name or trade mark as the originating address. It is allowed to use an alternative originating address as long as the company name or trade mark name is included in the message body. The Customer shall secure that the owner of mobile phone numbers (MSISDN) that are defined as originating address of mobile terminated SMS or MMS messages sent by the Customer, permits this practice. Telia has the right to stop the processing of such SMS and MMS messages that are abusing a MSISDN as originating address. The Customer shall comply with applicable data protection law in relation to use of the Positioning Product and the Terminal Detection Product. The Customer shall inter alia ensure that a valid consent has been obtained from the End Users before such data is being processed, unless processing is necessary for compliance with a legal obligation to which Telia is subject, and that appropriate measures are taken to provide the data subject with adequate information about the data processing. Use of the Products. (a) Except as otherwise stated in this agreement or an Order, the Customer will have the non-exclusive, limited right to use the Products during the Term (unless this agreement is terminated earlier in accordance with its terms) solely for the Purpose. (b) The Customer may allow its End Users to use the Products for the Purpose. Use of the Products by End Users is subject to the terms and conditions of 3CT’s end user license agreement (XXXX) available at xxxxx://xxx.0xxxxx.xxx.xx/wp-content/uploads/2020/03/3CT_05-EndUserLicenceAgreement_25.9.19.pdf or otherwise provided by 3CT. The Customer acknowledges that the XXXX may contain provisions which require End Users to comply with licence terms from third party licensors where third party licensor products are incorporated into or form part of the Products. The Customer must provide a copy of the XXXX to End Users and obtain the consent of End Users to the XXXX. The Customer must immediately notify 3CT of any known or suspected breach of the XXXX or other unauthorised use of the Products and assist 3CT in the enforcement of the terms of the XXXX. (c) The Customer is responsible for the compliance of its End Users with this agreement and each Order. (d) The Customer must use the Products and Professional Services in a manner which complies with all laws, including Telecommunications Laws. (e) 3CT may update the Products from time to time, provided such updates will not materially reduce the level of performance, functionality, security or availability of the Products during the Term, including to reflect changes in laws, regulations, technology, industry practices and availability of non-3CT products. (f) The Customer must not, and must not allow any End User or third party to: (a) decompile, disassemble, translate, reverse engineer or otherwise attempt to derive source code from, any portion of the Software; (b) sell, sublicense, rent, lease, distribute, market, or commercialise the Software, except as expressly permitted in this agreement; (c) directly or indirectly circumvent or violate the technical restrictions of the Software; (d) remove any identification, proprietary, copyright or other notices in the Software; or (e) modify or create a derivative work of any portion of the Software.
