Deficient Work definition

Deficient Work means any error, omission, breach or other non-conformance with respect to either the Work or Services to be provided under the terms of this Agreement.
Deficient Work. Any Work performed improperly or deficiently, due to action or voluntary omission, negligence, carelessness and imprudence, will be re-done under the sole and full responsibility of the Contractor, with no cost to the Owner, and without any extension of the Agreement Time or increase in the Agreement Sum.

Examples of Deficient Work in a sentence

  • The Core Team shall exert reasonable efforts to cause such Subcontractor, Supplier or Non-Risk Pool IPD Team Member to correct such Deficient Work.

  • In the event of any Deficient Work for which a Project Specific Insurance Policy is, or may be, available to respond, the Parties shall take prompt action to pursue recovery against such available Project-Specific Insurance Policy.

  • In the event such Subcontractor, Supplier or Non-Risk Pool IPD Team Member fails to correct such Deficient Work, the initial Core Team shall cause the correction of such Deficient Work, the cost of which shall be reimbursed as a Cost of the Work and subject to the limitation of liability in Article 28, provided always that any steps taken by the initial Core Team in this regard does not relieve the Subcontractor, Supplier or Non-Risk Pool IPD Team Member from its obligations.

  • Subject to the limitations of liability set forth in Article 28 and the allocation of responsibility for correction of Deficient Work as set forth in Article 7 and correction of Nonconforming Work as set forth in Article 23, each Party is fully responsible for the acts and omissions of its respective subcontractors, and consultants, and persons either directly or indirectly employed by them, or under their control, as it would be is for its own employees.

  • If City receives an invoice for Deficient work, City shall have the right to withhold all, or a portion of the requested reimbursement amounts related to the Deficient Work until Manager has demonstrated that the Deficient Work has been satisfactorily completed or otherwise addressed as described in Section 6.

  • Unless otherwise specified under the Contract, all costs associated with return, repair and/or replacement of Deficient Work Product shall be the sole responsibility of the Supplier, including all parts, labour, freight/handling charges, call-out fees, restocking charges, travel, accommodation, and other costs.

  • If Manager’s work fails to meet industry best practice standards or fails to meet the quality or acceptability required under this Agreement, or '’s work is otherwise found to be deficient or incomplete (Deficient Work), Manager shall perform all reasonable and necessary corrective action that adequately addresses the Deficient Work.

  • With expedient effort and without cost to the City, the Supplier shall either replace or repair any Deficient Work Product, as reasonably directed by the City, provided that such claim is made by the City to the Supplier by written notice received by the Supplier within one (1) year from the date of written approval of the original, repaired or replacement Work Product, as the case may be, unless otherwise set out under this Contract.

  • Contractor should be aware of the Deficient Work Payment Reduction Penalties for Non- Compliance with Price Agreement Specifications provisions detailed in Exhibit A.

  • Upon discovery of Deficient Work, City agrees it will provide written communication to Manager with a description of the Deficient Work and any corrective action that Manager must provide or facilitate in order to receive reimbursement for the Activity.

Related to Deficient Work

  • Project Work means the work required to complete the Project.

  • Contract Work means everything required to be furnished and done by the Contractor by any one or more of the parts of the Contract referred to in Article 1, except Extra Work as hereinafter defined.

  • Urgent Work means any urgent measures which in the opinion of Engineer-in-charge become necessary during the progress of the work to obviate any risk of accident or failure or disruption of generation which become necessary for security.

  • DAY WORK means on item of work requiring the employment of labour with or without materials as the case may be, which, in the opinion of the Senior Engineer /Civil-in-charge, is not capable of being evaluated by the accepted methods of measurement or assessment and is paid for on the basis of the actual labour and materials utilised on the particular item of work referred to.

  • Shift Work is defined as the same work performed by two or more employees or two or more successive sets or groups of employees working successive periods.
