Upon the final determination of the recoveries in respect of the Prins Boudewijn Reference Obligation and the payment in full of any amounts due to the Swap Counterparty pursuant to the terms of the Credit Default Swap Agreement, any applicable Cash Deposit Release Amount will, subject to the execution of the Deed of Payment, Release and Termination, be available to be distributed to the Noteholders in accordance with the Transaction Documents.
