Determination of Qualification definition

Determination of Qualification means a letter issued by ADOH, in accordance with I.R.C. § 42(m), that indicates that the Project, which has utilized tax-exempt financing, qualifies for an amount of Tax Credits and is in compliance at the time of the letter with all rules established by this Plan.

  • Eight percent (8%) of the ten percent (10%) Reservation Fee is due and payable within 30 days of Determination of Qualification letter with the remaining two percent (2%) of the ten percent (10%) Reservation Fee due and payable at final allocation and prior to issuance of STC eligibility letter.

  • I.R.C. § 42(h)(4) allows applications financed with tax-exempt bonds to apply for 4% LIHTCs.   • Disqualification Event shall have the meaning ascribed to such term in Section 3.1(rr).

  • TLAC Disqualification Event means OSFI has advised the Bank in writing that the bail-inable notes issued under the applicable pricing supplement will no longer be recognized in full as TLAC under the TLAC Guideline as interpreted by the Superintendent, provided that a TLAC Disqualification Event will not occur where the exclusion of those bail-inable notes from the Bank’s TLAC requirements is due to the remaining maturity of those bail-inable notes being less than any period prescribed by any relevant eligibility criteria applicable as of the issue date of those bail-inable notes.
