Examples of Duchy interest in a sentence
Subsection (2) applies to the extent that an interest in land is a Crown interest or a Duchy interest.
The appropriate authority in relation to any Crown interest or Duchy interest in land in the area of a local planning authority may enter into an obligation falling within any of paragraphs (a) to (d) of section 106(1) (in this section referred to as a “planning obligation”) enforceable to the extent mentioned in subsection (3).
A private interest is an interest which is neither a Crown interest nor a Duchy interest.
This Act shall have effect in relation to any land or other property in which there is a Crown or Duchy interest as it has effect in relation to land or other property in which there is no such interest.
In this section— • “private interest” means an interest which is neither a Crown interest nor a Duchy interest; • “statutory provisions” means provisions contained in or having effect under any enactment; and references to the disposal of an interest in Crown land include references to the grant of an interest in such land.
In this section— • “Crown land” means land in which there is a Crown interest or a Duchy interest; • “Crown interest” means an interest belonging to Her Majesty in right of the Crown, or belonging to a government department or held in trust for Her Majesty for the purposes of a government department; • “Duchy interest” means an interest belonging to Her Majesty in right of the Duchy of Lancaster, or belonging to the Duchy of Cornwall.
An interest in land in which there is a Crown or Duchy interest may, if the appropriate authority consent to the acquisition thereof, be acquired compulsorily by virtue of this Act, and a power (other than one to acquire land compulsorily) may, if the appropriate authority consent to its being so conferred, be conferred by a harbour revision or empowerment order in relation to land in which there is a Crown or Duchy interest.
While subsection (1) is about purchase notices relating to private interests in Crown land, subsections (2) and (3) place constraints on the ability to serve a purchase notice in respect of a Crown interest or a Duchy interest.
Subsection (3) provides that no one may serve a purchase notice in relation to a Crown interest or a Duchy interest in land that is not referred to in subsection (2)(a) to (d).
Subject to subsection (4) above, the power conferred by section 17 above shall be exercisable in relation to land in which there is a Crown or Duchy interest only with the consent of the appropriate authority.
