Eastern Power Networks means Eastern Power Networks Plc company registration number 2366906 of Newington House, 000 Xxxxxxxxx Xxxxxx Xxxx, Xxxxxx XX0 0XX; Index means either the Retail Price Index, the BCIS Index as set out in clause 7.2; Indexed means the calculation of any Council and County Council payments specified in this Agreement (unless stated to be indexed differently) by applying the following formula: Interest means interest at 4% (four percent) above the base lending rate of the Co- Operative Bank Plc from time to time; Monitoring Fee means the payment of £25,000 towards the Council's reasonable and proper administrative costs of monitoring compliance with the provisions of this Agreement; NPPF means the National Planning Policy Framework dated July 2021 published by the Secretary of State; Plan means the plan attached to this Agreement at Appendix 1; Planning Permission means the planning permission subject to conditions to be granted by the Inspector or Secretary of State pursuant to the Appeal subsequent to the completion of this Agreement and FOR THE AVOIDANCE OF DOUBT not that granted pursuant to the First Appeal Decision which was subsequently quashed; Retail Price Index means the All Items Retail Prices Index or if such index ceases to be published such other equivalent; Secretary of State means the Secretary of State for Department for Levelling Up, Housing and Communities Schedules means Schedules 1 to 10 contained in this Agreement; Thames Water Utilities means Thames Water Utilities Limited (company registration number 02366661) of Clearwater Court, Vastern Road, Reading, Berkshire RG1 8DB; and Working Day(s) means any day on which clearing banks in the City of London are (or would be but for a strike lock-out or other stoppage affecting such banks generally) open during banking hours.
