Elan Patents definition

Elan Patents shall have the meaning set forth in the Elan License Agreement.

• If the infringement of the Elan Patents affects the Field as well as other products being developed or commercialised by Elan or its commercial partners outside the Field, the Parties shall agree as to the manner in which the proceedings should be instituted and shall reach agreement as to the proportion in which they will share the proceeds of any such proceedings, and the expense of any costs not recovered, or the costs or damages payable to the Independent Third Party.

Elan Patents means Elan's drug delivery inventions and underlying Patents (including oral or mucosal Vaccine delivery inventions) and inventions and underlying Patents relating to oral or mucosal Vaccines, other than the Elan Program Patents and the Elan Excluded Technology;
