Existing development definition

Existing development means development, other than that associated with agricultural or forest management activities, that meets one of the following criteria:
Existing development means development in exis- tence on October 1, 2004, or development for which a notice of intent to apply for a storm water permit in accordance with subch. III of ch. NR 216 was received by the department or the depart- ment of commerce on or before October 1, 2004.
Existing development means those projects that are built or those projects that have established a vested right under North Carolina law as of the effective date of the state stormwater program or applicable local government ordinance to which the project is subject.
