FERC Allowances Determination definition

FERC Allowances Determination means the FERC order or orders, including orders on rehearing, directing the payment (including by offset) of Fuel Cost Allowances and/or Emissions Offsets and/or Cost Offsets in the EL00-95 Proceeding, regardless of whether such order or orders is/are subject to requests for stay, rehearing or appeal, provided that such order or orders has/have not been stayed pending such rehearing or appeal.
FERC Allowances Determination means the FERC order directing the payment of Fuel Cost Allowances in the FERC Refund Proceedings, regardless of whether such order is subject to requests for stay, rehearing or appeal, provided that such order has not been stayed pending such rehearing or appeal.

Examples of FERC Allowances Determination in a sentence

  • If neither FERC nor the court of appeals specifies the time and manner for such payments, then such payments shall be made by wire transfer no later than 20 Business Days after the date that the applicable court of appeals order or FERC order on remand changing the FERC Interest Determination or the FERC Allowances Determination has become final and no longer subject to appeal.

  • Such Participants that become Settling Participants will not receive or be liable for payment until the date on which FERC requires Participants to pay such allowances in the FERC Refund Proceedings, at which time the payments owed to or owing from such Participants will be adjusted based on the FERC Allowances Determination.

  • Settling Participants are responsible for their ultimate allocable share of the agreed upon Fuel Cost Allowance and Emissions Offset, with the allocation based on the FERC Allowances Determination.

  • The proposed allocation of charges for such Cost Offset to individual Participants shall be subject to adjustment and “true-up” to comply with the FERC Allowances Determination.

  • To the extent Reliant’s total Fuel Cost Allowance is determined by FERC in the FERC Allowances Determination to be greater than $63,250,845, Reliant shall be entitled to recover from each Non-Settling Participant that Non-Settling Participant’s allocable share of the difference, including, notwithstanding anything to the contrary in Section 4.2, any associated interest on the difference, as determined by FERC.

  • If neither FERC nor the court of appeals specifies the time and manner for such payments, then such payments shall be made by wire transfer within twenty (20) Business Days after the date that the applicable FERC or court of appeals order changing the FERC Interest Determination, the FERC Allowances Determination, the FERC Receivables Determination, or the FERC Refund Determination has become final and no longer subject to appeal.

  • If neither FERC nor the court of appeals specifies the time and manner for such payments, then such payments shall be made by wire transfer as soon as practicable after the date that the applicable court of appeals order or FERC order on remand changing the FERC Interest Determination or the FERC Allowances Determination has become final and no longer subject to appeal.

  • The proposed allocation of charges for such allowance to individual Market Participants, which is currently based on gross load, shall be subject to adjustment and “true-up” to comply with the FERC Allowances Determination.

  • To the extent Reliant’s total Fuel Cost Allowance is determined by FERC in the FERC Allowances Determination to be less than $63,250,845, Reliant shall be responsible for paying to each Non-Settling Participant that Non-Settling Participant’s allocable share of the difference, including any associated interest on the difference, as determined by FERC.

  • Such Market Participants that become Settling Participants (“Net Payers”) will not receive or be liable for payment until the date that FERC requires Market Participants to pay such allowances in the FERC Refund Proceedings, at which time the payments owed to or owing from such Net Payers will be adjusted based on the FERC Allowances Determination.

  • SOFR Determination Date has the meaning specified in the definition of “Daily Simple SOFR”.

  • Claim Determination Period means a calendar year. However, it does not include any part of a year during which a person has no coverage under This Plan, or any part of a year before the date this COB provision or a similar provision takes effect.

  • Monthly Report Determination Date The meaning specified in Section 10.7(a).

  • Expert Determination has the meaning given to it in Clause 18.3(a) (Expert Determination).

  • Self-Determination means a philosophy and process by which individuals with developmental disabilities are empowered to gain control over the selection of support services that meet their needs. The basic principles of self-determination are:

  • LIBOR Determination Date With respect to any Interest Accrual Period for the LIBOR Certificates, the second London Business Day preceding the commencement of such Interest Accrual Period.

  • SOFR Determination Day has the meaning specified in the definition of “Daily Simple SOFR”.

  • Event Determination Date means either:

  • Capitalization Reimbursement Amount As to any Distribution Date, the amount of Advances or Servicing Advances that were added to the Stated Principal Balance of the related Mortgage Loans during the prior calendar month and reimbursed to the Master Servicer or Subservicer on or prior to such Distribution Date pursuant to Section 3.10(a)(vii), plus the Capitalization Reimbursement Shortfall Amount remaining unreimbursed from any prior Distribution Date and reimbursed to the Master Servicer or Subservicer on or prior to such Distribution Date.

  • Benchmark Determination Date means (a) if the Benchmark is LIBOR, the LIBOR Determination Date, (b) if the Benchmark is Term SOFR, the date that is two Business Days before the first day of the applicable Accrual Period, (c) if the Benchmark is Compounded SOFR, the date that is five Business Days before the last day of the applicable Accrual Period and (d) if the Benchmark is any other rate, the date determined by the Trust according to Section 2.16 of the Indenture.

  • Spread Determination Date means, for the reset rate notes, any time after the Notice Date but no later than 3:00 p.m., New York City time, on the third business day prior to the related reset date.

  • Reset Dividend Determination Date means, in respect of any Reset Period, the day falling three Business Days prior to the beginning of such Reset Period.

  • Extension Determination Date means, in respect of a Series of Covered Bonds, the date falling two Business Days after the expiry of seven days from (and including) the Final Maturity Date of such Covered Bonds.

  • Interest Determination Date means, with respect to a Rate of Interest and Interest Accrual Period, the date specified as such hereon or, if none is so specified, (i) the first day of such Interest Accrual Period if the Specified Currency is Sterling or (ii) the day falling two Business Days in London for the Specified Currency prior to the first day of such Interest Accrual Period if the Specified Currency is neither Sterling nor euro or (iii) the day falling two TARGET Business Days prior to the first day of such Interest Accrual Period if the Specified Currency is euro.

  • Payment Determination Date means, with respect to any Payment Date, one (1) Business Day immediately preceding such Payment Date.

  • Administrative merits determination means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. An administrative merits determination may be final or be subject to appeal or further review. To determine whether a particular notice or finding is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.

  • Reset Determination Date means, in respect of the First Reset Period, the second Business Day prior to the First Reset Date and, in respect of each Subsequent Reset Period thereafter, the second Business Day prior to the first day of each such Subsequent Reset Period;

  • Term SOFR Determination Day has the meaning assigned to it under the definition of Term SOFR Reference Rate.

  • Adverse Benefit Determination means any of the following:

  • Dividend Determination Date means, for the purposes of the definition of “Dividend”, the date on which the number of Ordinary Shares or, as the case may be, amount of other property or assets, which may be issued or delivered is, or is capable of being, determined, and where determined by reference to prices or values or the like on or during a particular day or during a particular period, the Dividend Determination Date shall be deemed to be such day or the last day of such period, as the case may be;

  • TIA Applicability Determination As defined in Section 12.12.

  • Periodic Term SOFR Determination Day has the meaning specified in the definition of “Term SOFR”.

  • SOFR Interest Determination Date means the day that is the number of U.S. Government Securities Business Days prior to the Interest Payment Date in respect of the relevant Interest Period, as specified in the applicable Pricing Supplement.In addition to defining the relevant Interest Periods and Interest Payment Dates, the applicable Pricing Supplement shall specify and describe, as applicable, any relevant interest commencement date, interest period end date, interest determination date, index maturity, rate cut-off date, any other terms relating to the particular method of calculating interest on the Compound SOFR Note (including any applicable payment delay, lockout or suspension period, lookback or observation shift) and any other terms applicable specifically to such Compound SOFR Note.Average SOFR NotesUnless otherwise provided for or modified in the applicable Pricing Supplement, Average SOFR Notes will bear interest at a rate per annum equal to Average SOFR (as defined below) plus the Spread.With respect to any Interest Period, unless otherwise specified or modified in the applicable Pricing Supplement, “Average SOFR” will be calculated by the Calculation Agent on each SOFR Interest Determination Date (as defined below) as follows (with the resulting percentage being rounded, if necessary, to the nearest one hundred-thousandth of a percentage point, with 0.000005 being rounded upwards to 0.00001): 0 Where:
