Group I Available Funds definition

Group I Available Funds. As defined in Section 7.3(a)(i) hereof.
Group I Available Funds. With respect to any Distribution Date and the Group I Mortgage Loans, an amount equal to the excess of (i) the sum of (a) the aggregate of the related Monthly Payments received on or prior to the related Determination Date, (b) Liquidation Proceeds, Insurance Proceeds, Principal Prepayments, Subsequent Recoveries and other unscheduled recoveries of principal and interest in respect of the Group I Mortgage Loans during the related Prepayment Period, (c) the aggregate of any amounts received in respect of a related REO Property withdrawn from any Protected Account and deposited in the Master Servicer Collection Account for such Distribution Date, (d) the aggregate of any amounts deposited in the Master Servicer Collection Account by the related Servicer or the Master Servicer in respect of related Prepayment Interest Shortfalls for such Distribution Date and (e) the aggregate of any related Monthly Advances made by the related Servicer or the Master Servicer for such Distribution Date, over (ii) the sum of (a) related amounts reimbursable or payable to the related Servicer or the Master Servicer pursuant to Sections 4.03 and 4.05, (b) related Stayed Funds, (c) related amounts deposited in the Master Servicer Collection Account or the Distribution Account, as the case may be, in error and (d) any Extraordinary Trust Fund Expenses.
Group I Available Funds. With respect to any Distribution Date, an amount equal to the excess of (i) the sum of (a) the aggregate of (1) the principal portion of Monthly Payments on the Group I Loans received during the related Due Period (regardless of whether such Monthly Payment was due during such related Due Period, was due during a Due Period prior to such Due Period or was a "pay-ahead" due for a Due Period subsequent to such Due Period) and (2) the interest portion (net of related Servicing Fees) of Monthly Payments on the Group I Loans due during the related Due Period and received prior to the related Determination Date (and any other interest, net of related Servicing Fees, due on any Loan for a Due Period prior to such Due Period, to the extent received by the Master Servicer prior to the related Determination Date and not applied by the Master Servicer in reimbursement of an Advance made by the Master Servicer in respect of such Mortgage Loan for a Distribution Date prior to the current Distribution Date), (b) Liquidation Proceeds, Insurance Proceeds, Principal Prepayments and other unscheduled recoveries of principal and interest (but not of Prepayment Charges) in respect of the Group I Loans during the related Due Period, (c) the aggregate of any amounts received in respect of a related REO Property withdrawn from any REO Account and deposited in the Collection Account for such Distribution Date, (d) the aggregate of any amounts deposited in the Collection Account by the Master Servicer in respect of related Prepayment Interest Shortfalls for such Distribution Date, (e) the aggregate of any Advances made by the Master Servicer with respect to the Group I Loans for such Distribution Date, (f) the aggregate of any related advances made by the Trustee for such Distribution Date pursuant to Section 7.02, (g) in the case of the first Distribution Date, the related Initial Deposit, (h) with respect to the Distribution Date immediately following the end of the Funding Period, any amounts (exclusive of investment income) in the Pre-Funding Account after giving effect to any purchase of Subsequent Loans and (i) with respect to each Distribution Date during the Funding Period and the two Distribution Dates immediately following the Funding Period, any amounts withdrawn by the Trustee from the Interest Coverage Account for distribution on the Group I Certificates over (ii) the sum of (a) related amounts reimbursable or payable to the Master Servicer pursuant to Section 3.11(a)...

Examples of Group I Available Funds in a sentence

  • The interest portion of any Realized Losses with respect to the Group I Mortgage Loans or Group II Mortgage Loans occurring on or prior to the Group I Cross-Over Date or Group II Cross-Over Date, respectively, will not be allocated among any Certificates, but will reduce the amount of Group I Available Funds or Group II Available Funds, respectively, on the related Distribution Date.

  • The amounts described in the preceding sentence, as determined separately with respect to the Group I Loans, and Group II Loans, with respect to each Distribution Date are the "Group I Available Funds" and "Group II Available Funds" for such Distribution Date.

Group I Available Funds. An amount equal to the sum of (a) Group I-1 Available Funds, (b) Group I-2 Available Funds, (c) Group I-3 Available Funds and (d) Group I-4 Available Funds.

Group I Available Funds. For any Distribution Date and Loan Group I, an amount which generally includes, (1) all previously undistributed payments on account of principal (including the principal portion of Monthly Payments, Principal Prepayments and the principal amount of Net Liquidation Proceeds) with regard to the Group I Mortgage Loans, less any Capitalization Reimbursement Amount to the extent such amount relates to any Mortgage Loan in the related Loan Group, and all previously undistributed payments on account of interest received after the Cut-Off Date and on or prior to the related Determination Date and any proceeds from a repurchase of a Group I Mortgage Loan or from an optional termination relating to Loan Group I, (2) any Monthly Advances made by the Master Servicer or a Servicer for such Distribution Date in respect of the Group I Mortgage Loans, (3) any Compensating Interest made by a Servicer for such Distribution Date in respect of the Group I Mortgage Loans and (4) any amounts reimbursed by the Master Servicer or the Trustee in connection with losses on certain eligible investments, net of all fees payable to, and amounts reimbursable to, the Servicers, the Master Servicer, the Trustee and the Custodian as provided in this Agreement and the Custodial Agreement and investment earnings on amounts on deposit in the Master Servicer Collection Account and the Distribution Account in connection with funds attributable to Loan Group I.
Group I Available Funds. As of any Payment Date, the amount on deposit in the Certificate Account with respect to the Group I Mortgage Loans on such Payment Date after making the deposits to the Certificate Account pursuant to Sections 7.3(a)(i) hereof on such Payment Date. The term "Group I Available Funds" does not include Insured Payments and does not include any amounts that cannot be distributed to the Owners of the Certificates by the Trustee as a result of proceedings under the United States Bankruptcy Code.
