Such amount shall, in the first instance, be used to pay the Independent Fiduciary Fees and Costs and Settlement Administration expenses actually and reasonably incurred.
The Settlement Amount—after the deduction of amounts to be approved by the Court for Class Counsel’s Attorneys’ Fees and Expenses and Case Contribution Awards to the named Plaintiffs, as well as Administration Costs, Independent Fiduciary Fees and Costs, and Taxes and Tax-Related Costs2—and Anticipated Future Benefit will be distributed to eligible Class Members pursuant to a Plan of Allocation to be approved by the Court.

Defendant or its insurer will pay a total of $1,000,000 cash to the Settlement Fund, which includes the amounts to be distributed to the Class Members as well as the Settlement Administration Costs, Attorney’s Fees and Expenses, Case Contribution Award to the Class Representative, and Independent Fiduciary Fees and Costs.
