Infrastructure Owner definition

Infrastructure Owner means the party described at Item 2 of the Reference Schedule. Item means an Item in the Reference Schedule. Lot means a lot in the strata titles scheme for the Strata Company.
Infrastructure Owner mean the person or entity retaining possession of the property on which the Construction Work is undertaken, including where the person or entity is the leasing party of the property or has the right to occupy the property for the purpose of undertaking the Construction Work.
Infrastructure Owner means the entity that accedes to the BOT Convention as the Infrastructure Owner pursuant to Article 2.9(b) of the BOT Convention, and any other entity which is duly appointed to replace it pursuant to the terms and conditions of the BOT Convention on or before the Transfer Date, or pursuant to the terms and conditions of the Basic Convention on or after the Transfer Date.

  • This Contract can be varied by written agreement of the Strata Company, Party Benefitting and the Infrastructure Owner.

  • If the Strata Company, the Infrastructure Owner or Party Benefitting are in dispute and if reasonable attempts to resolve the dispute have failed, either the Strata Company, Party Benefitting or the Infrastructure Owner can refer the dispute to the Tribunal in accordance with section 197 of the Act.

  • The Infrastructure Owner is not responsible under clause 3.1.3 for any damage caused as a result of an unreasonable act or omission: by the owner of the damaged Lot; or by the Strata Company if the damage is to Common Property.

  • Notwithstanding clause 5, the Strata Company consents to the Infrastructure Owner making an application for planning approval or any other approval required by regulation 65 of the Regulations or any approval required by any other written law to enable the Infrastructure to be lawfully installed within the Easement Area.

  • Nothing in this Contract implies that the Infrastructure Owner is required to renew or replace any Common Property.
