Initial Software definition

Initial Software means the Software in its Source Code and possibly its Object Code form and, where applicable, its documentation, "as is" when it is first distributed under the terms and conditions of the Agreement.
Initial Software means the first versions of the Software delivered to ---------------- Licensee pursuant to this Agreement, together with any modifications thereof delivered to remedy any non-compliance with the warranties under Sections 6.1.1 and 6.1.2.
Initial Software means the first version of each Software product that ---------------- Primus delivers to Distributor pursuant to this Agreement, together with any modifications thereof delivered to remedy any non-compliance with the warranties under Sections 9.3.1-9.3.3.

Initial Software means the Software in its Source Code and its Object Code form and any applicable documentation when it is first released by the Licensor.

  • Open Source Software means software or similar subject matter that is distributed under an open source license such as (by way of example only) the GNU General Public License, GNU Lesser General Public License, Apache License, Mozilla Public License, BSD License, MIT License, Common Public License, any derivative of any of the foregoing licenses, or any other license approved as an open source license by the Open Source Initiative or as a free software license by the Free Software Foundation.

  • Embedded Software means one or more software applications which permanently reside on a computing device.

  • Software means computer programs, whether in source code or object code form (including any and all software implementation of algorithms, models and methodologies), databases and compilations (including any and all data and collections of data), and all documentation (including user manuals and training materials) related to the foregoing.

  • Custom Software means Software identified as such in Appendix 4 of the Contract Agreement and such other Software as the parties may agree in writing to be Custom Software.
