Involuntary Proceeding definition

Involuntary Proceeding means any of the following instituted against a party by any other person or entity: (i) assignment for the benefit of creditors, (ii) proceeding seeking relief under any federal or state bankruptcy or insolvency laws, or (iii) proceeding seeking the appointment of a receiver, trustee, custodian or similar official for such party’s business or assets.
Involuntary Proceeding has the meaning assigned to such term in Section 7.01(h).
Involuntary Proceeding means a child custody proceeding in which the parent does not consent of the parent’s free will to the foster care, preadoptive, or adoptive placement or termination of parental rights or in which the parent consents to the foster care, preadoptive, or adoptive placement under threat of removal of the child by a state court or agency. 25 C.F.R. § 23.2.

Examples of Involuntary Proceeding in a sentence

  • If an Involuntary Proceeding shall be commenced against either party and shall remain undismissed for a period of sixty (60) days.

Involuntary Proceeding shall have the meaning set forth in Section 10.1(g) hereof.
