  • Notwithstanding anything to the contrary in the Contract Documents, no compensation or time extension shall be allowed with respect to: (a) any Unknown Karst Features that could have been avoided by reasonable design modifications or construction techniques; (b) any costs that could have been avoided; (c) Unknown Karst Features on any DB Contractor-Designated ROW; or (d) any Known Karst Features.

  • Accelerator-produced material means any material made radioactive by a particle accelerator.

  • Contractor attributional/proprietary information means information that identifies the contractor(s), whether directly or indirectly, by the grouping of information that can be traced back to the contractor(s) (e.g., program description, facility locations), personally identifiable information, as well as trade secrets, commercial or financial information, or other commercially sensitive information that is not customarily shared outside of the company.
