Licensor Software definition

Licensor Software means the object code version (or, in the case of a Cloud Service a machine and or disk image) of the Licensor's product on all supported Platforms then currently available, including Documentation and any subsequent Updates provided under Maintenance. Licensor Software excludes Third Party Software.
Licensor Software means Licensor’s software programs licensed to Mercury Interactive hereunder and described in Exhibit A, in Object Code format, and includes all Updates thereto.
Licensor Software or “Licensed Software” means the Object Code versions of Licensor’s software technology, as described in Exhibit A. Licensor Software includes any Updates, Upgrades and other modifications of the Licensor Software that Licensor may provide to Licensee under this Agreement, where “Update” and “Upgrade” are defined below.

Examples of Licensor Software in a sentence

  • If the Licensor Software does not perform as warranted during the Warranty Period, Licensor shall use commercially reasonable efforts to correct Errors.

  • You agree that you will not nor permit your users to export or re-export the Licensor Software, Documentation and Materials in any form in violation of any applicable export or import laws of any jurisdiction.

  • Licensor hereby agrees at its own expense to defend or, at its option, settle, any claim or action brought against Customer to the extent it is based on a claim that the Licensor Software, or Materials, all as updated by Licensor and used in accordance with the Agreement, infringes any patent, copyright, or any trade secret of a third party.

  • If the foregoing remedies are not commercially feasible (in the reasonable opinion of Licensor), Licensor may (i) cancel the applicable Order form and, as applicable, for the AFFECTED Licensor Software or Software Services, refund the license fees and any unearned maintenance fees paid to Licensor by Customer for the affected Licensor Software or Software Services, or (ii) for Consulting Services refund all amounts paid to Licensor by Customer for the affected Consulting Services.

  • The Licensor Software enables the Yahoo! Software to perform certain functions including, without limitation, access proprietary data on third-party data servers.


More Definitions of Licensor Software

Licensor Software means the software developed and owned by Licensor used for the analysis in connection with the Services as further set out in the Handover Specification.

Licensor Software a proprietary management and control software system used in connection with the deployment and operation of the Licensor System. Licensor Software Updates: such updates to the Licensor Software, if any, that Licensor may create from time to time. Any Licensor Software Updates provided shall become a part of the Licensor Software upon provision of such to Licensee hereunder.
Licensor Software means Licensor’s Ecolane DRT software, in object code format, licensed to Licensee hereunder and, in the event Licensee purchases applicable license, all updates and upgrades provided under the Support Services, if any. The “Mobile Module” shall be deemed part of the Licensor Software for all purposes except Section 2.1(a).
