Material Deviations definition

Material Deviations means a deviation from a requirement is material if the deficient response is not in substantial accord with the RFP requirements, provides an advantage to one proposer over other proposers, or has a potentially significant effect on the delivery, quantity or quality of items proposed, amount paid to the vendor or on the cost to the Department. Material deviations cannot be waived.
Material Deviations means a variation up or down in the Suggested Retail Prices of greater than ten (10) percent.
