Material Originator definition

Material Originator has the meaning set forth in the Sale Agreement.
Material Originator means, as of any date of determination, any Originator or group of Originators, collectively, the Receivables of which constitute at least 7.5% of the average of the Net Receivables Balances determined as of the last day of each of the three consecutive Collection Periods occurring immediately prior to such date of determination.
Material Originator means any Originator originating more than 10% of the Receivables during any twelve months period.

More Definitions of Material Originator

Material Originator means any of the following at any time, so long as such Person is an Originator: (i) COALSALES II, LLC, a Delaware corporation, (ii) Powder River Coal, LLC, a Delaware limited liability company, (iii) Peabody Western Coal Company, a Delaware corporation, (iv) Peabody Midwest Mining, LLC, an Indiana limited liability company and (v) any other Originator now or hereafter party to the Sale Agreement whose Receivables represent 15% or more of the aggregate Receivables originated by the Originators in any calendar month during the immediately preceding 12 Settlement Periods.
Material Originator means, on any date of determination, any Originator who originated more than 30% of the total Receivables originated during the month then most recently ended.
Material Originator means any proposed New Originator which generated Receivables during the 12-month period most recently ended prior to the effectiveness of such Person’s addition hereto as an Originator in excess of 10% of all Receivables generated by the then existing Originators during such 12-month period.
Material Originator means, on any date of determination, any Originator that originates at least 10% of the Outstanding Balance of all Receivables (as defined in the RSCA) in the 6-Calculation Periods then most recently ended.

Material Originator means an Originator, if the aggregate amount of Principal Receivables originated by such Originator and held by the Issuer is equal to or greater than two percent (2%) (by dollar amount) of the Combined Outstanding Principal Balances; provided, that if the aggregate amount of Principal Receivables originated by an Originator and held by the Issuer is less than two percent (2%) (by dollar amount) of the Combined Outstanding Principal Balances (such Originator may be referred to as a “Less than 2% Originator”), then such Less than 2% Originator and all other Less than 2% Originators shall be treated as a single Material Originator if the sum of the aggregate amount of Principal Receivables originated by such Less than 2% Originators and held by the Issuer is equal to or greater than two percent (2%) (by dollar amount) of the Combined Outstanding Principal Balances.
Material Originator means either (i) Lloyds Bank or (ii) any other originator selling and assigning Receivables to the Transferor or to an Additional Transferor and retaining title to designated Accounts representing at least 20 per cent. of the Principal Receivables in the Securitised Portfolio at the date of determination, which is nominated as such to the Receivables Trustee on the date on which such designated Accounts are first offered to the Receivables Trustee.
