In the event that the Director determines that a Modification Proposal should be implemented in terms of this Clause 76, this Agreement shall, subject to Clauses 76.4 and 76.7, be deemed to be varied with effect from the date specified by the Director, without any requirement for further action unless required by the Director.
In the event that, in the opinion of Scottish Settlements, a Modification Proposal is likely to affect the Central Allocation System and/or CAS Software, Scottish Settlements shall use its reasonable endeavours to obtain from the Operating Agent and any suppliers of Software or other contractor an initial assessment of the costs and timescale of implementing the Modification Proposal.
