Monetary Settlement Terms. 3.1 Civil Penalty Payment Pursuant to Health and Safety Code section 25249.7(b)(2), and as consideration for the releases contained in Sections 4.1 and 4.2 below, Xxxxxxxx agrees to pay $3,600 in civil penalties no later than ten (10) days after the Effective Date. The penalty payment will be allocated in accordance with California Health and Safety Code section 25249.12(c)(I) & (d), with 75% of the penalty amount remitted to the California Office of Environmental Health Hazard Assessment ("OEHHA") and the remaining 25% of the penalty amount paid to Xxxxxxx and delivered to the address in Section 3.3 herein.

(a) “OEHHA” in the amount of $750 and (b) “Xxxx Xxxxxxx, Client Trust Account” in the amount of $250. Thereafter, Xxxxxxx’x counsel shall send OEHHA’s portion of the penalties paid by Grocery Outlet to OEHHA.

Monetary Settlement Terms. 3.1 Civil Penalty Payment Pursuant to Health and Safety Code § 25249.7(b)(2), and in settlement of all claims alleged in the Notice or referred to in this Settlement Agreement, DeLallo agrees to pay four thousand dollars ($4,000.00) in civil penalties. The penalty payment will be allocated in accordance with California Health and Safety Code §§ 25249.12(c)(1) & (d), with 75% of the penalty amount paid to the California Office of Environmental Health Hazard Assessment (“OEHHA”) and the remaining 25% of the penalty amount retained by EHA. Within ten (10) days of the date this Settlement Agreement is executed by the Parties, DeLallo shall issue two separate checks for the initial civil penalty payment to (a) “OEHHA” in the amount of three thousand dollars ($3,000.00) and (b) Environmental Health Advocates, Inc., in the amount of one thousand dollars ($1,000.00). Pursuant to Health and Safety Code section 25249.7(b), Max Sales shall pay the civil penalties described herein, with payments allocated according to Health and Safety Code section 25249.12(c)(1) and (d), with 75% of the penalty amount paid to the California Office of Environmental Health Hazard Assessment (“OEHHA”) and the remaining 25% of the penalty paid to Xxxxxxx, as follows: Within five days of the Effective Date, Max Sales shall provide its civil penalty payment in two checks for the following amounts made payable to: (a) “OEHHA” in the amount of $1,500; and (b) “Xxxxxxxx Xxxxxxx” in the amount of $500.
