Neutral Determination definition

Neutral Determination is defined in Section 1.04.

  • Each party shall have the right to submit a written presentation to the Neutral Accountant regarding the items raised in the Dispute Notice and the Neutral Accountant shall be instructed to determine (the "Neutral Determination") the unresolved matters in dispute, applying the principles set forth in this Section 1.04, and, twenty (20) Business Days after being selected, to deliver a written report to Buyer and Seller setting forth the Neutral Determination and the reasons therefor.

  • Administrative merits determination means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. An administrative merits determination may be final or be subject to appeal or further review. To determine whether a particular notice or finding is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.

  • Arbitration Tribunal means an organ composed of an odd number of persons known as arbitrators, who decide on the solution of a conflict in which the parties have expressly waived recourse to the ordinary civil courts

  • TIA Applicability Determination As defined in Section 12.12.

  • Dispute Board (DB) means the person or persons named as such in the SCC appointed by agreement between the Procuring Entity and the Contractor to make a decision with respect to any dispute or difference between the Procuring Entity and the Contractor referred to him or her by the Parties pursuant to GCC Sub-Clause 46.1 (Dispute Board) hereof.

Each Dispute Notice will be effectively delivered if delivered in the manner agreed between the parties for the giving of notices in respect of this Agreement.

  • Event Determination Date means either:

  • Arbitrator means the authority nominated by Chief General Manager (CGM) for arbitration.

  • Reviewing Party any appropriate person or body consisting of a member or members of the Company's Board of Directors or any other person or body appointed by the Board who is not a party to the particular Claim for which Indemnitee is seeking indemnification, or Independent Legal Counsel.
