New Merchants definition

New Merchants means Merchants who began accepting Visa Credit Cards or Mastercard Credit Cards during the Class Period and after May 31, 2018, and for clarity, does not include Merchants who had an opportunity to opt-out in any of the Previous Settlements.
New Merchants means Settlement Class Members who began accepting Visa and/or Mastercard credit cards after September 4, 2015.
New Merchants has the meaning specified in Section 3.8(i)(i)(A). “Non-Competition, Non-Solicitation and Confidentiality Agreements” means the non-competition, non-solicitation and confidentiality agreement to be entered into by the Purchaser and the Key Holders, at or prior to this Agreement and effective at the Effective Time, in the form substantially as set out in Exhibit “C” hereto.
