Nominated Contractor A contractor engaged by the Commonwealth (other than the Consultant) and notified as such in writing by the Commonwealth.
The Consultant acknowledges that: the Commonwealth may from time to time request the Consultant to agree to be directly engaged by a Nominated Contractor rather than the Commonwealth; or Nominated Contractors may from time to time request the Consultant to agree to tender for a direct engagement with the Nominated Contractor.
