The undersigned representatives of the Owner, the Holder, and Ohio EPA represent and certify that they are each authorized to execute this Covenant.
Forbearance by Ohio EPA to exercise its rights under this Covenant in the event of any breach of any of its terms shall not be deemed or construed to be a waiver by Ohio EPA of such term or of any subsequent breach of the same.
The above Conservation Values and other conservation values of the Property have been identified and included in the Property’s final Restoration and Protection Plan as approved by Ohio EPA (“Plan”).
The effective date of this Covenant shall be the later of: (a) the date upon which the Owner and Holder, and Ohio EPA have signed the Covenant, or (b) the date the Owner has acquired title to the Property, in which latter case representations made by the Owner in this Covenant as to the Property will take effect on the date of title acquisition.
Ohio EPA shall have the right to post one or more signs on the Property that indicate that the Property’s acquisition has been financed by Ohio EPA and the Program.
