DEA may unilaterally terminate this MOA at any time for cause without prior notice by issuing an ISO pursuant to 21 U.S.C. § 824(d) against Grower’s registration as governed under this MOA, or by issuing an Order to Show Cause as to which a final decision is reached by DEA to suspend or revoke Grower’s registration as governed under this MOA.
If any of the Litigating Plaintiffs fail to cure the deficiencies or show good cause why their case should not be dismissed with prejudice within 21 days of the entry of the Order to Show Cause, those Litigating Plaintiffs’ claims will be dismissed with prejudice.
