Examples of P2P SCCs in a sentence
Section 5 of this DPA represents Customer’s express consent regarding existing and new Sub-processors under Clause 9(a) of the SCCs. On request by Customer, Braze shall make available to Customer a copy of the applicable P2P SCCs with applicable Sub-processor(s), and for the avoidance of doubt, not the entirety of the DPA with such Sub-processor(s).
To the extent legally permitted, any and all communications, instructions, notifications, enquiries, requests, correspondence, co-operation, and assistance intended under the SCCs or P2P SCCs (i) between Braze and Data Subjects, shall be made exclusively via Customers; and (ii) between Customer and Sub-processors, shall be made exclusively via Braze.
Braze shall in accordance with Clause 9(d) notify the Customer of any failure by the Sub-processor to fulfil its obligations under the P2P SCCs where such a failure leads to Braze being in material breach of this DPA.
Similarly, if aUS customer is a processor of Customer Personal Data under the EU GDPR (e.g. because its processing activities relate to the offering of goods to EEA residents), it will need to use the new EU P2P SCCs for these transfers (in addition to the new EU C2P SCCs if it is also a controller).
Note that even if a customer in this category is processing Customer Personal Data on behalf of others (rather than on its own behalf)7 or is a true processor under European Data Protection Law, the new EU P2C SCCs are more suitable for use in these circumstances than the new EU P2P SCCs, because the laMer assume that the data expofier issues instructions to the impofier, while the reverse is true here (i.e. the customer as data impofier issues instructions to its Google service provider as expofier).
