Participating private institution of higher education. MEANS A PRIVATE INSTITUTION OF HIGHER EDUCATION THAT ENTERS INTO A PERFORMANCE CONTRACT WITH THE DEPARTMENT PURSUANT TO SECTION 23-5-128 AND AGREES TO PARTICIPATE IN THE PROGRAM.
