After the Project has achieved Full Capacity Deliverability Status, Seller may, at its option, make a one-time, irrevocable election to utilize the full capacity deliverability payment allocation factors set forth in Appendix C by providing Notice to Buyer within sixty (60) days of achieving Full Capacity Deliverability Status. Any such election shall only be effective with respect to payments for periods beginning on or after the first day of the calendar month following receipt of such Notice and “Payment Allocation Factors” shall mean, with respect to such periods, the full capacity deliverability payment allocation factors set forth in Appendix C.
