Examples of Performance Guarantors in a sentence
The obligations of each of the Performance Guarantors under this Agreement are independent of the Guaranteed Obligations, and a separate action or actions may be brought and prosecuted against each Performance Guarantor to enforce this Agreement, irrespective of whether any action is brought against any of the Guaranteed Parties or whether any of the Guaranteed Parties is joined in any such action or actions.
It is a condition precedent to the effectiveness of the Receivables Loan and Security Agreement that each of the Performance Guarantors shall have executed and delivered this Agreement.
To the extent permitted by law, no automatic stay under the Bankruptcy Code or other federal, state or other applicable bankruptcy, insolvency or reorganization statutes to which WCF, Trendwest or the Issuer is subject shall postpone the obligations of the Performance Guarantors under this Guaranty.
