  • Unloading of non-compliant vehicles will be refused and those vehicles will be required to leave the Port Terminal Facility.

  • If a Transportation Vehicle fails inspection, Viterra may require that a Transportation Vehicle is removed from the Port Terminal Facility or berth and the Client must comply with that requirement.

  • Notwithstanding any other clause in this Agreement, CBH will apply a Shrinkage factor to all Grain delivered by the Customer to the Port Terminal Facility to determine the quantity of Grain that CBH is obliged to Outturn on behalf of the Customer.
