More Definitions of Portfolio Interest Exemption

Portfolio Interest Exemption shall have the meaning set forth in Section 2.16(g)(iv).
Portfolio Interest Exemption means an exemption from U.S. tax for certain “portfolio interest” under the U.S. Tax Code.
Portfolio Interest Exemption means the exemption from U.S. tax under Section 871(h) or Section 881(c) of the Internal Revenue Code.
Portfolio Interest Exemption shall also furnish a United States Tax Compliance Certificate to the effect that such Lender is not a “bank” within the meaning of Section 881(c)(3)(A) of the Tax Code, a “10 percent shareholder” of Borrower within the meaning of Section 871(h)(3)(B) of the Tax Code, or a “controlled foreign corporation” related to Parent Borrower as described in Section 881(c)(3)(C) of the Tax Code, together with a Form W-8BEN (or W-8BEN-E or successor form). Notwithstanding any other provision of this Section 2.20(d), a Foreign Lender shall not be required to deliver any form pursuant to this Section 2.20(d) that such Foreign Lender is not legally able to deliver.
