Project Disturbance Area definition

Project Disturbance Area or “ground disturbance area” means all areas that would be temporarily or permanently disturbed during construction or operation of the Project, including all linear facilities, or which would be subject to any project-related ground, habitat, or species disturbing action.

  • The amount of the required initial payment or security for this item shall be adjusted for any change in the Project Disturbance Area as described above.

  • Compensatory mitigation shall be at a ratio of 3:1 for CNDDB Rank 1 plants, with three acres of habitat acquired or restored/enhanced for every acre of habitat occupied by the special status plant that will be disturbed by the Project Disturbance Area (for example if the area occupied by the special status plant collectively measured is ¼ acre than the compensatory mitigation will be ¾ of an acre).

  • Habitat enhancement or restoration activities must achieve protection at a 3:1 ratio as described above, with improvements applied to three acres of habitat for every acre of special-status plant habitat directly or indirectly disturbed by the Project Disturbance Area for annual species; or to habitat supporting three living plants for each individual perennial plant directly or indirectly disturbed by the project.

  • Mitigation for CNDDB Rank S1 and S2 Plants: If species with a CNDDB rank of S1 (CDFG 2010b), excluding small-flowered androstephium (CNDDB S1.2), are detected within the Project Disturbance Area or would be directly impacted by discharges from or the diversion of streams around the Project, the Project owner shall implement avoidance measures to protect at least 75 percent of the local occurrence(s) of the species.

  • Special-status plant occurrences within 100 feet of the Project Disturbance Area shall be protected from herbicide and soil stabilizer drift.

  • Harassment is intended to cause distress upon or negatively affect the reputation of a member of the community.

Related to Project Disturbance Area

  • Building Contractor means the building contractor or developer appointed or to be appointed by the Grant Recipient in respect of a Firm Scheme; Business Day means any day other than a Saturday, Sunday or a statutory Bank Holiday in England;

  • Project means the goods or Services described in the Signature Document or a Work Order of this Contract.

  • Non-Disturbance Agreement shall have the meaning set forth in Section 8.8.9.

  • Disturbance Control Standard or “DCS” shall mean the reliability standard that sets the time limit following a disturbance within which a balancing authority must return its Area Control Error to within a specified range.

  • Disturbance means the placement or reconstruction of impervious surface or motor vehicle surface, or exposure and/or movement of soil or bedrock or clearing, cutting, or removing of vegetation. Milling and repaving is not considered disturbance for the purposes of this definition.

  • Drainage area means a geographic area within which stormwater, sediments, or dissolved materials drain to a particular receiving waterbody or to a particular point along a receiving waterbody.

  • tidal work means so much of any work authorised by this Order as is on, under or over tidal waters or tidal lands below the level of high water;

  • Condominium Project Real estate including the separate ownership in fee, or on a satisfactory leasehold estate, of a particular residential unit with an indivisible interest in the real estate designated for common ownership strictly by unit owners.

  • Commercial building means a non-residential building other than an agricultural building, an industrial building or an institutional building.

  • Service Areas means those areas within the Building used for stairs, elevator shafts, flues, vents, stacks, pipe shafts and other vertical penetrations (but shall not include any such areas for the exclusive use of a particular tenant).

  • Plant Site (Works, Factory) means the local integration of one or more plants, with any intermediate administrative levels, which are under one operational control, and includes common infrastructure, such as:

  • Building Contract means a contract entered into between the Grant Recipient and a Building Contractor relating to the construction, repair, refurbishment, conversion, development and/or Rehabilitation (as applicable) of a Firm Scheme; Building Contractor means any building contractor or developer appointed or to be appointed by the Grant Recipient in respect of a Firm Scheme; Business Day means any day other than a Saturday, Sunday or a statutory Bank Holiday in England;

  • Building Common Areas means with respect to the Tower, the areas, facilities and amenities specified in Schedule [E] which are to be used and enjoyed in common with all the other Apartment Acquirers of the Units in the Building; and

  • Rural areas means any area within the county located outside the

  • Environmentally critical area means an area or feature which is of significant environmental value, including but not limited to: stream corridors, natural heritage priority sites, habitats of endangered or threatened species, large areas of contiguous open space or upland forest, steep slopes, and well head protection and groundwater recharge areas. Habitats of endangered or threatened species are identified using the Department’s Landscape Project as approved by the Department’s Endangered and Nongame Species Program.

  • Serious emotional disturbance means a diagnosable mental, behavioral, or emotional disorder affecting a minor that exists or has existed during the past year for a period of time sufficient to meet diagnostic criteria specified in the most recent Diagnostic and Statistical Manual of Mental Disorders published by the American Psychiatric Association and approved by the department and that has resulted in functional impairment that substantially interferes with or limits the minor's role or functioning in family, school, or community activities. The following disorders are included only if they occur in conjunction with another diagnosable serious emotional disturbance:

  • Historic building means a building, including its structural components, that is located in this state and that is either individually listed on the national register of historic places under 16 U.S.C. 470a, located in a registered historic district, and certified by the state historic preservation officer as being of historic significance to the district, or is individually listed as an historic landmark designated by a local government certified under 16 U.S.C. 470a(c).

  • Project Site(s) means the place(s) specified in the SCC for the supply and installation of the System.

  • Improvement completion assurance means a surety bond, letter of credit,

  • Project Water means water made available for delivery to the contractors by project conservation facilities and the transportation facilities included in the System.

  • Water surface elevation means the height, in relation to the National Geodetic Vertical Datum (NGVD) of 1929, the North American Vertical Datum (NAVD) of 1988, or other datum, where specified, of floods of various magnitudes and frequencies in the floodplains of riverine areas.

  • Water Surface Elevation (WSE means the height, in relation to NAVD 1988, of floods of various magnitudes and frequencies in the floodplains of riverine areas.

  • Natural area means an area of the rural or non-urban environment which is in an unspoilt natural state or is of high scenic value, and includes, but is not limited to, national parks, game reserves, nature reserves, marine reserves, wilderness areas, areas of extensive agriculture and scenic areas.

  • Easement Area means the area of the servient lot marked on the survey-strata plan as being subject to the relevant easement; and

  • Coastal area means coastal area as defined in section 22a-93(3) of the Connecticut General Statutes. “Coastal waters” means coastal waters as defined in section 22a-93(5) of the Connecticut General Statutes. “Commissioner” means commissioner as defined in section 22a-2(b) of the Connecticut General Statutes.

  • Project Property means the real property on or for which preconstruction service or construction work is or will be provided.
