During the process of construction of the Project, Developer shall obtain policies of builder's risk completed value non-reporting form of fire and extended coverage, vandalism and malicious mischief hazard insurance naming the Village as an additional insured and covering the Project in at least the amount of the estimated cost of replacement of the Project, with provision that such coverage will not be terminated without 30 days prior written notice to the Village.
During Construction. 6.24.1.1 The DB shall maintain in good order at a secure location on the Site:
.1 a complete copy of all Contract Documents; Shop Drawings, Product Data, Samples and similar required submittals; manufacturer operating and maintenance instructions; certificates; warranties; RFIs and responses thereto; and other Project-related documents, all marked currently and accurately to record field changes and selections made during construction and to show actual installation where installation varies from Work as originally shown, including the exact location and depth of underground utility lines; and
.2 a set of Drawings and Specifications, approved in accordance with Section 5.8.1.1, and the records required by Section 6.2.14.
6.24.1.2 Before submitting each DB Payment Request, the DB shall record all changes on the Contract Documents, neatly in a contrasting color, noting new information not shown on the original Contract Documents. Failure to record all changes may cause payment to be withheld or delayed by the Contracting Authority.
6.24.1.3 The DB shall keep a record of changes made to the Specifications, noting particularly any approved variation from manufacturer’s installation instructions and recommendations.
6.24.1.4 If the DB uses Shop Drawings to indicate as-built conditions, the DB shall cross-reference the Shop Drawing sheet numbers to the corresponding sheet numbers on the Contract Documents. The DB shall note related numbers where applicable.
6.24.1.5 The DB shall at all times permit access to the documents described in this Section 6.24.1 to authorized representatives of the State, local authorities having jurisdiction, Contracting Authority, Owner, and Criteria A/E.

Prior to the inspection for Material Completion of the Project Contractor shall remove from the Site all wastes and rubbish, clean all tile and glass surfaces, replace broken glass, remove stains, paint spots, and clean and polish all plumbing fixtures and equipment, leave the Work “vacuum clean” or its substantial equivalent, all hard surface floors swept and mopped, all carpeted floors vacuumed, all surfaces other than floors dusted, blower dusted, or wiped (depending on type of surface) and surface blemishes cleaned, all glazing washed [both sides], and all electrical and mechanical equipment and fixtures cleaned, with all ductwork cleaned and filters replaced, if such are dirty, before other cleaning is started, and re-cleaned if any dust or dirt has gotten into the ductwork during the cleaning process. The Contractor shall restore existing facilities such as roads, other paved surfaces, fencing, curbing and the like at the Site to at least their preconstruction conditions; provided, however, the Contractor may, in an orderly fashion, leave such equipment and supplies at the Site as necessary to achieve Final Completion of the Project. This cleaning must be completed before the Contractor can expect the Design Professional to commence the inspection for Material Completion. Unless otherwise determined under Section 1.2(b), for all Investments under construction (and prior to deemed completion and in-service) begun after the Lease Effective Date, the Applicable Cost of Debt (in %) shall be equal to the actual interest rate paid by Lessor to finance the cost of constructing such Investments.
During Construction. (a) Lender will have the right to take over and cause the Project to be completed and, for that purpose, make disbursements from the undisbursed Loan funds. Any contract entered into or indebtedness incurred on the exercise of such right may be exercised by Xxxxxx in the name of Xxxxxxxx, and Xxxxxx is hereby irrevocably appointed attorney-in-fact (the appointment being coupled with an interest) to enter into the contract, incur such obligations, enforce contracts or loan agreements theretofore made by or on behalf of Borrower, and to do any and all things necessary or proper to complete the work of construction, including the signing of Xxxxxxxx’s name to such contracts and documents as may be deemed necessary by counsel for Xxxxxx. In no event will Lender be required to use its own funds to complete the Project if undisbursed Loan funds are insufficient, but Lender may, at its option, advance such funds.
