  • Qualifying illness shall not include (i) physical or mental impairment voluntarily induced by the employee, including, but not limited to, impairment arising from illegal or immoral conduct, (ii) unjustified fighting,(iii) illness or injuries suffered in or arising from military service or other gainful employment, (iv) injuries suffered while on excused or educational leave, and (v) impairment due to use of any intoxicating beverage or any controlled substance.
