Recoverable Value definition

Recoverable Value means the mass of recoverable content of cane delivered by a grower to a mill for crushing, which mass represents recoverable sugar moderated by the value of recoverable molasses of such cane, taking into account adjustments in respect of the sucrose, non-sucrose and fibre content thereof, and which mass of recoverable content shall be calculated in terms of the procedures contained in the Official Methods Manual;
Recoverable Value means the net dollar amount that a prudent lender could reasonably expect to recover by liquidating a particular piece of collateral. Recoverable Value is determined by deducting the following amounts from the Liquidation Value of the collateral: (a) the balance owed on senior liens (less amounts waived or subordinated by a Loan Document); (b) Recoverable Expenses associated with any necessary lien foreclosure action; and (c) if the collateral is likely to be acquired by BCIDA or the Lender at the foreclosure sale (e.g., real property), the expenses associated with the care, preservation and resale of the acquired collateral.
Recoverable Value means the sum of the gross cash proceeds from all sales of the Company’s assets on or after March 15, 2020 (whether product sales in the ordinary course of business, liquidation sales, enterprise sale or non-ordinary course transactions) net of ordinary course operating expenses, but before satisfaction of (i) extraordinary transaction or other fees or expenses related to implementation of any strategic alternative, (ii) restructuring fees and expenses, and (iii) any administrative expenses required to be paid under the Chapter 11 Plan (whether paid prior to, on, or after the effective date of the Chapter 11 Plan). Recoverable Value is intended to measure the full benefit to the Company or its estate of any enterprise sale or other strategic transaction, and shall be calculated to include all cash consideration (including the full value of any amounts held back at closing of any such sale or transaction, which amounts shall be included as if all such amounts had been paid in full in cash at the closing) and non-cash consideration (including by treating assumed liabilities as if they had been paid in cash, in full at the closing). Recoverable Value shall be determined by the Board.

  • For Recoverable Value - enter an estimate of the scrap or other value of materials that could be reused after the project.

  • If the Servicing Request will impact the collateral, a thorough analysis of its Recoverable Value, before and after the requested modification, should be conducted.

  • A Protective Bid should be entered at a senior lienholder's foreclosure sale if the Recoverable Value of the property is 10% or more of its Liquidation Value, unless abandonment is appropriate, (i.e., Recoverable Value of less than $10,000 for real property and $5,000 for personal property collateral), or a prudent lender would not enter a Protective Bid based on the circumstances that are not reflected in the Appraisal, but are documented in the Loan File.

  • The maximum amount of a Protective Bid should be the lesser of the balance owed on the SBA loan or the Recoverable Value of the collateral.

  • If redemption rights are available under federal or state law but it would not be prudent or commercially reasonable to redeem the foreclosed-upon property, after the senior lienholder's foreclosure sale has been confirmed, the redemption rights associated with the SBA loan may be released upon receipt of cash in an amount approximately equal to 50% of the property's Recoverable Value.

Recoverable Value means the amount equal to (i) Ending Cash plus (ii) eighty-five percent (85%) multiplied by Ending Accounts Receivable plus (iii) seventy percent (70%) of Inventory allocated to Qualifying Orders plus ten percent (10%) of the non-allocated Inventory plus (iv) twenty-five percent (25%) multiplied by Prepaid Expenses plus (v) twenty-five percent (25%) multiplied by Fixed Assets plus (vi) Expected Backlog Margin minus (vii) Accounts Payable minus (viii) Other Current Liabilities (excluding customer deposits).

  • full insurable value means one hundred percent (100%) of the actual replacement cost of the Property (excluding foundation and excavation costs and costs of underground flues, pipes, drains and other uninsurable items).

  • Nonrecoverable Property Protection Advance shall have the meaning assigned to the term in the Servicing Agreement or such other analogous term used in the Servicing Agreement.

  • Total Asset Value means as of any date of determination the sum (without duplication) of all of the following of the Borrower, the REIT Guarantor and their Subsidiaries on a consolidated basis determined in accordance with GAAP applied on a consistent basis: (a) cash and Cash Equivalents, plus (b) with respect to each Property (other than Development Properties, the Market Square Property and Properties with a negative Net Operating Income) owned for four (4) consecutive fiscal quarters by the Borrower, the REIT Guarantor or any of their respective Subsidiaries, the quotient of (i) Net Operating Income less Capital Reserves attributable to such Property (without regard to its occupancy) for the prior fiscal quarter of the Borrower most recently ended times four (4), divided by (ii) the applicable Capitalization Rate, plus (c) with respect to each Property acquired during the most recent four (4) fiscal quarters of the Borrower, the greater of (i) the quotient of (A) Net Operating Income less Capital Reserves attributable to such Property (without regard to its occupancy) for the prior fiscal quarter of the Borrower most recently ended times four (4), divided by (B) the applicable Capitalization Rate, and (ii) the undepreciated GAAP book value (after taking into account any impairments) of such Property, plus (d) with respect to the Market Square Property, the greater of (1) the quotient of (A) Net Operating Income less Capital Reserves attributable to the Market Square Property (without regard to its occupancy) for the prior fiscal quarter of the Borrower most recently ended times four (4), divided by (B) the Capitalization Rate for CBD or Urban Infill Properties, and (2) the undepreciated GAAP book value (after taking into account any impairments) of the Market Square Property, plus (e) the undepreciated GAAP book value (after taking into account any impairments) for Construction-In-Process for Development Properties, plus (f) the undepreciated GAAP book value (after taking into account any impairments) of Unimproved Land. The Borrower’s pro rata share of assets held by Unconsolidated Affiliates (excluding assets of the type described in the immediately preceding clause (a)) will be included in Total Asset Value calculations consistent with the above described treatment for wholly owned assets. For purposes of determining Total Asset Value, Net Operating Income from Properties acquired or disposed of by the Borrower, any Subsidiary of the Borrower or any Unconsolidated Affiliate during the immediately preceding four (4) fiscal quarters of the Borrower shall be excluded from clause (b) above. For purposes of determining Total Asset Value, Total Asset Value attributable to the following investments in excess of the limitations set forth below shall be excluded from Total Asset Value:

  • Total Assets as of any date means the sum of (i) the Undepreciated Real Estate Assets and (ii) all other assets of the Company and its Subsidiaries determined in accordance with GAAP (but excluding accounts receivable and intangibles).
