Recovery Costs definition

Recovery Costs means all Recovery Costs as defined in Section 850(b)(10) of the Wildfire Financing Law.
Recovery Costs has the meaning set forth in Section 8.4(d).

  • Nothing contained in this Section 9.2 shall relieve either Party from (i) liability for any Fraud, or Willful and Material Breach of any provision of this Agreement prior to the termination of this Agreement or (ii) its obligation to pay the Valaris Termination Fee, Transocean Termination Fee or Recovery Costs, as applicable and if, as and when required pursuant to this Article 9.


More Definitions of Recovery Costs

Recovery Costs has the meaning ascribed thereto in Section 9.5(c);
Recovery Costs means (a) all reasonable and direct costs and expenses for offshore archaeological operations with respect to a Covered Shipwreck, plus any costs of conservation, documentation, certification, legal fees, transportation and any other costs that are reasonably necessary to complete a project related to such Covered Shipwreck, in each case incurred by Magellan or any of its Affiliates; (b) any payments or percentages to owners, governments or other entities as may be negotiated or determined by a court of competent jurisdiction; (c) any percentages up to 5.0% paid or incurred as marketing fees; and (d) any percentages paid to investors, provided that those obligations were disclosed in advance and Odyssey has been provided with a right of refusal to participate proportionally in any investment that may be required to fund the project for such Covered Shipwreck to prevent any dilution to Odyssey’s economic interest in Covered Shipwreck.
Recovery Costs means the “securitization costs” (as defined in the Kentucky Utilities Act) recoverable pursuant to the Financing Order through the issuance of the Bonds, including the Financing Costs.
Recovery Costs means all fees, costs and expenses (including any payments Transco NTS may be required to make by way of damages or costs or otherwise by any court) incurred by Transco NTS in taking Recovery Steps (but not including amounts in respect of Transco NTS 's own internal costs and expenses);

Recovery Costs has the meaning given to that expression in Section L10.17 (Recovery Costs).
Recovery Costs shall have the meaning given to such term in Section 7.08(c).
