Extension Notice has the meaning specified in Section 308.
Consent Notice has the meaning set forth in Section 4.6(a).
Acquisition Notice has the meaning set forth in Section 2.6(a).
Designation Notice means a notice from any Lender or an Affiliate of a Lender substantially in the form of Exhibit I.
Replacement Notice is defined in Section 4.11.
Non-Extension Notice has the meaning specified in Section 2.10.
Restatement Effective Date means the date on which the conditions specified in Section 4.01 are satisfied (or waived in accordance with Section 9.02).
Payment Notice has the meaning assigned to it in Section 8.06(c).
Activation Notice have the meanings ascribed thereto in Annex C.
Repayment Notice Each notice required to be delivered by the Borrower pursuant to Section 2.3 in respect of any reduction in the Facility Amount or repayment of Advances Outstanding, in the form of Exhibit A-2.
Disagreement Notice has the meaning specified in Section 2.04(c).
Confirmation Notice means a notice provided by the Issuer to an Investor in accordance with clause 1.3(c) of the Terms;
Opt-Out Notice has the meaning specified therefor in Section 2.02(a) of this Agreement.
Non-Extension Notice Date has the meaning specified in Section 2.03(b)(iii).
Notice of Extension has the meaning specified in Section 2.20.
Notice of Extension/Conversion means the written notice of extension or conversion in substantially the form of Schedule 3.2, as required by Section 3.2.
Commencement Notice means a written notice, given by any Secured Party to the other Secured Parties in accordance with the notice provisions set forth in the Securities Purchase Agreement, pursuant to which such Secured Party notifies the other Secured Parties of the existence of one or more Events of Default and of such Secured Party’s intent to commence the exercise of one or more of the remedies provided for under this Agreement with respect to all or any portion of the Collateral as a consequence thereof, which notice shall incorporate a reasonably detailed description of each Event of Default then existing and of the remedial action proposed to be taken.
CAFA Notice refers to the notice requirements imposed by 28 U.S.C. § 1715(b).
Requisite Notice means a notice delivered in accordance with Section 10.02.
First Restatement Effective Date means the “Restatement Effective Date” as defined in the First Amendment Agreement.
Addition Notice With respect to the transfer of Subsequent Mortgage Loans to the Trust Fund pursuant to Section 2.08, a notice of the Depositor's designation of the Subsequent Mortgage Loans to be sold to the Trust Fund and the aggregate principal balance of such Subsequent Mortgage Loans as of the Subsequent Cut-off Date. The Addition Notice shall be given not later than three Business Days prior to the related Subsequent Transfer Date and shall be substantially in the form attached hereto as Exhibit P.
Amendment and Restatement Effective Date means June 28, 2018, the date the amendments and restatements to the Plan of May 7, 2018 are subject to approval by the Company’s stockholders at the Company’s 2018 Annual Meeting.
Collection Notice means a notice, in substantially the form of Annex A to Exhibit VI, from the Agent to a Collection Bank.
Credit Event Notice means an irrevocable notice from the Issuer or the Swap Counterparty, as the case may be, to the other party (in the form and delivered in the manner described in the Default Swap) that describes a Credit Event that occurred on or after the Effective Date of the Default Swap.
Prepayment Notice means a notice by the Borrower to prepay Loans, which shall be in such form as the Appropriate Party may approve.
Publication Notice means the summary notice of proposed Settlement and hearing for publication substantially in the form attached as Exhibit 3 to Exhibit A.
